ERYC Byelaw Fiasco

There has been much talk of how EU legislation has been imposed on UK citizens. What is not discussed are the byelaws, local laws, introduce by our own local councils to control, and even prevent, many simple pleasures in our lives.

The East Riding of Yorkshire Council (ERYC) hold many byelaws but fail to undertake the most basic of functions to ensure they are enforceable. This is in addition to preventing lawful access to them. After a five month battle, today, I finally exercised my right to see the byelaws, held by ERYC.

As can be seen below, the legislation states:

“A copy of the byelaws, when confirmed, shall be printed and deposited at the offices of the authority by whom the byelaws are made”

ERYC have existed for nearly two decades, and until this week, to deal with my request to view them, they have failed this fundamental requirement. This failure has made all byelaws held by ERYC unenforceable.

Consequences 

  1. Fines of up to £2,500 have been unlawfully issued to countless people for breaching unenforceable byelaws.
  2. ERYC MUST now refund all these fines.
  3. Those who have been unlawfully prosecuted may have wrongly received a criminal record.
  4. This criminal record could have affected family life, business and even holidays abroad.

Bigger Picture

With over 430 councils across the UK this is a national scandal. It has robbed the general public of £millions in unlawful fines, ruined lives, careers and prevented family holidays.

Byelaw Restrictions

Restrictions on byelaws affect much of our life, especially our social life, including taxis, opening hours, children’s play, fishing, bait digging, cycling, bathing, kite flying, camping, dogs, walking, railways and canals.

Any restrictions ERYC have made to our lives for the past two decades where unenforceable because they failed to switch on a basic photo copier. Can incompetence get any worse or more simple to put right?

As ERYC have failed to:

  1. Deposit a copy of every byelaw made by the council at their offices until this week and
  2. Send a copy of every byelaw made by the council, and confirmed, to the proper officer of the council, whether separate or common, of every parish or community to which they apply.

I would like to register a formal complaint against ERYC.

In addition:

Any enforcement action currently taking place in relation to byelaws must be cancelled immediately and

Any money received from fines must be reimbursed.

Dear Debbie,

Thank you for making copies of the byelaws available to me this morning.

Could I please request copies of all the byelaws? Please advise as to cost and timescale.

I am at a lost how it is not cost effective for ERYC to publish all the byelaws on their website. This is such a simple, unskilled procedure. Surely the ERYC would never condone the deliberate withholding of such important information from the public.
